The Criminal Responsibility of the Head of the State in Islamic Jurisprudence
Abstract:
This study aimS to clarify and discuss the criminal responsibility of the head of state in Islamic jurisprudence, and tries to answer the following questions:
· Is the position of the head of state considered an impediment to criminal responsibility?
· Is this position considered one of the reasons for raising the penalty even if the criminal aspect is still not removed?
The study concludes that this position is not considered an impediment to criminal responsibility, and is not a reason for lifting the penalty on the head of state if he commits what necessitates it.
