Abstract:

Surrogacy agreements is a "contract when a woman commits to rent her womb and use for the development of the artificially fertilized fetus inside it for a period of pregnancy, for an agreed fee  to hand over the baby to his father after the birth." It is one of the contracts that have emerged recently, to overcome the problem of infertility of women, for the reason of the inability of the uterus to carry out its functions, this contract is subjected to the general rules in civil law, but it is invalid legally, because of the invalidity of the subject and the reason, for their violation of public order and public morals, though it is legal permissible in most Western countries.It is also forbidden and non-religiously action in the Islamic religion, as it is a challenge to the will of Allah (SWT), in which suspicion of mixing genealogy, finally it is an attack on values and ethics.
