Omar Mukahhal
Abstract: This paper attempts to elucidate the tracking down (ta’aqubat) of Alhafez Ibin Hajar al-Asqalani in his book “Fath al-Bari” to what Hafez Al-Mazzi mentioned in his book “Tohfat al-Ashraf Bima’rifat al-Attraf” regarding a number of Hadiths. The paper also comments on Ibin Hajar’s criticism of Al-Mazzi’s remarks, and shows their scientific value and corrects the wrong remarks. It should be noted, however, that the number of Hadiths tracked down by Ibin Hajar is very small when compared with the total number of Hadiths quoted in Tohfat al-Ashraf.

Rohile Gharaibeh
Abstract: The mojarity of Islamic jurists agree upon the authority of Analogy and its considearton as evidence to proving legal judgments. They have not agreed upon its authority in all aspects. But they agreed on its application in the proplem of legal punishments and atonements, because those are issues in which personal judgment and worship are involved. This research aims at clarifying the dispute among the jurists and the scholars of Usul over this partiality, to stand at the evidence provided by the different juridical schools, and to furthermore try to reach a preponderant opinion after presenting counter-arguments and discussions. After that exploration of the important effects caused by this dispute, which its benefits appear in the branches and the juridical proplems that are solved according to the mentioned Analogy, and also after investigation in this effect, it was found that other rules were involed in solving these issues and problems, which led to the anouncement of reasoning problematics, that are needed through reflection. At the end of this research the conclusion was more tilted in favour of the claim that the dispute is mainly a matter of articulation and technicalities. However, the preponderance of one opinion over the other still persists.

The research is based on the grounds that arabic is a linguistic system; and it takes care of studying the systems of computer and information technology; because the research limits the phonetic units in arabic. Accordingly the research uses the phonetic transcription in order to restrict the internal links that are connected with the rules of morphology in arabic (derivation, inflections, and morphology formations), in the course of forming the arabic verb. The research carefully deals with testing of capacity of grammer that it reaches as to interpret the relation between the structural formations, and their meanings according to the norm that the research depends on. The research consists of an introduction and three parts, including the previous studies, building of the verb and its meaning, the verb Al – mu’tal, Al-mahmuz, and Al-mudha’f, and the Isnadi.
