Abstract:
This research addresses the inherent rights of personality in Islamic law and civil law and their role in strengthening the human rights protection system. This topic is related to the sub-branches and has roots in the chapters of jurisprudence, yet it has not received the study commensurate with its importance and need. The aim of this research is to explain the philosophy of Islamic legislation and the legal traditions in outlining a cumulative structure for building personal rights and preserving human rights. It also aims to clarify the inherent rights of personality in Islamic law and civil law and their role in strengthening the human rights protection system, and to examine the legal and Shari'a dimensions of the violation of personal rights. In this research, the inductive and analytical approaches were followed. Among the most prominent findings of the research is that Islamic law guarantees human beings their personal rights, such as the right to life, which is considered the foundation of human rights, as well as intellectual rights, political rights, and economic and social rights.
