Abstract:
The research tackles the protection of the environment in Islamic law and Jordanian law. The research presents the definition of the environment and mentions its elements and forms of protection in the Islamic law and the Jordanian law.The study also clarified all the specific rulings in Islamic Sharia derived from the Quran and the Sunnah, leading to the establishment of the objective of environmental protection within its rightful place among the collective body of Sharia evidence. The researcher concluded that, according to some contemporary scholars, environmental protection has evolved into a fundamental objective that is essential to the five higher objectives of Sharia, and may even be considered a sixth objective or the overarching purpose of all objectives. The research also included studying the role of the law in protecting elements of the environment and clarifying the civil and criminal penalties resulting from exposure to any element of the environment in violation of the provisions of the law. At the end of the research, the researcher recommended the necessity of spreading awareness of the importance of Environmental education and its relationship to succession. He also called for transforming individuals' interest in caring for the environment from an innate legal interest to an ideological interest.
